The
Prospect Response FFA Network refers to the collection of FFA pages at
http://Prospect Response.com. The Prospect Response Service refers to any
service offered on the Prospect Response website.
The
Prospect Response FFA Service refers to any service offered on the Prospect Response
website connected to the Prospect Response FFA network.
The
Prospect Response Directory Service refers to the FREE or paid (GOLD)
submission of your URL and classified ad.
The
Prospect Response Service is available for use only by those who agree
to abide by these posting terms.
If
your email address rejects or bounces back incoming email, or is otherwise
invalid it is subject to being banned.
Autoresponder
email addresses are not allowed to post to the Prospect Response FFA Network
or be used in any aspect of the Prospect Response service.
Posting,
submitting or any other use of any email address you are not authorized
to use is strictly prohibited. Prospect Response tracks IP address with
every posting and may institute legal action and or report any abuse
to the proper authorities.
The
Prospect Response Service may be used for lawful purposes only. Submission,
transmission or storage of pornography and sex-related content and
merchandising and/or any material in violation of any international,
federal or any state law or regulation is expressly prohibited.
Prospect Response
does NOT allow any of its members to send unsolicited e-mail 'Spam'.
Any form of Electronic Spamming referencing Prospect Response, or any
of the Prospect Response websites is strictly forbidden, including but
not limited to unsolicited email, Bulk E-mail, or Inappropriate newsgroup
posts. Prospect Response reserves the sole discretion of determining what
constitutes Spam. Any of our members accused of any incident of Spam
that links to the Prospect Response website will lose their website plus
any commissions or membership contributions due to them. Prospect Response
may at its discretion, press legal charges due to Spam.
Prospect Response
allows its members to make email contact with personally referred
members to encourage them to upgrade to GOLD or be active resellers.
However, Prospect Response strongly prohibits sending any promotional
messages not directly related to Prospect Response. If you are found having
being involved in such cross-solicitation, your account may be terminated
with loss of any commissions and membership benefits.
The
Prospect Response directory service
By submitting your ad to the Prospect Response service, you agree to receive
promotional messages from Prospect Response GOLD members. You also agree
to receive occasional email from Prospect Response. DO NOT submit your
links if you disagree with this. All promotional messages coming from
the Prospect Response servers will always have identifiable removal instructions.
You
agree not to provide false or misleading information on the Prospect Response
Service. This includes, but is not limited to, providing false name
and or e-mail address. Any commissions due will be paid to the name
on your file in our database. It is your responsibility to keep your
contact details including current email and mailing address updated
at all times. Prospect Response cannot be held responsible for lost commissions
due to inaccurate personal details.
The
Prospect Response FFA service
The Prospect Response FFA submitter is the submitter located on our site
that submits to any of the Prospect Response FFA pages or the Prospect Response
FFA network. By posting your link to the Prospect Response FFA Network
using any third party software, you agree to abide by these posting
terms.
Posting
to the Prospect Response FFA Network using multiple email addresses is
prohibited.
By
submitting to the Prospect Response FFA Network, you agree to receive
confirmation emails which may contain advertisements in response from
some of our Prospect Response GOLD members. These messages will not be
sent by Prospect Response or sent through our servers. Each such message
will have its own independent removal instructions. You must request
the members individually for removal if you do not with to receive
further messages from them. In addition, you agree to be added to
the Prospect Response mailing list. DO NOT post your link to the Prospect Response
FFA Network if you do not agree with this.
Submitting
your link to the Prospect Response FFA Network may result in many confirmation
emails being sent to your email address. These emails may be in their
hundreds. Do not post your link to the Prospect Response FFA Network if
you are not equipped to handle this.
PR™ Responder
By using the PR™ Responder service, you agree not to import
email addresses of people who have not authorized you to do so. A
confirmation emails is always sent before you can be able to send
messages to your PR™ Responder subscribers.
You also understand that Prospect Response
may freeze or terminate your account if you are found not to obey
this rule. PR™ Responder is only available to GOLD members.
You understand you'll be unable to access your PR™ Responder
account if your account falls to a free account.
Removing
Yourself From Prospect Response
The only way to stop receiving messages from Prospect Response is to delete
your account. Every email message coming through our servers carries
explicit information about your account and how to cancel/delete it.
Since Prospect Response is not a "mailing list", you must log into your
account's member's area and delete your account from the link provided
for this purpose. If you have signed up more than once, you must delete
each account separately. By deleting your account, you agree to forfeit
all the benefits of a paid account, and any commissions earned, if
any.
By
using the Prospect Response service, you also agree to abide by the following
rules.
If
you are dissatisfied with any aspect of the Prospect Response Service
or with any of our terms, conditions, rules, policies, guidelines,
or practices, your sole and exclusive remedy is to discontinue using
the Prospect Response Service.
If
you order the GOLD membership and your payment is by credit card,
you authorize Prospect Response, through our payment processors (WorldPay
and PayPal) to charge the credit card listed on the subscription form.
The charge to your credit card is one time unless stated otherwise.
All
paid services are only offered after payment has been received in
advance. Paid accounts will be terminated if any payment reversal
or refund takes place.
You
understand that although Prospect Response closely monitors the contents
of information and data passing through its facilities, the Prospect Response
service is of such a nature that Prospect Response may not be in a position
to control such information and data once it has been sent. By using
the Prospect Response Service, you agree that Prospect Response cannot be
held liable for any damages resulting from or arising out of receiving
such messages.
Paying
customers are entitled to 30-day money back guarantee. No refunds
will be issued after 30 days after purchase. Prospect Response will only
issue refunds to customers who provide their transaction number (or
order ID). This is always provided when every transaction is approved.
The Prospect Response member ID (username) must also be provided. Refunds
cannot be issued for reasons other than dissatisfaction RESULTING
FROM FAILURE OF Prospect Response TO PROVIDE THE SERVICE AS DESCRIBED
ON THE Prospect Response WEBSITE. Prospect Response will not issue a refund
after services have been rendered. In cases where only partial services
may have been rendered, only the amount corresponding to the percentage
of service not yet rendered can be refunded, less any commissions
that may already have been paid out to the referring Resellers (Affiliates).
Any
paid Prospect Response Service may be terminated with an e-mail message.
The transaction number (or order ID) and Prospect Response member ID (username)
must also be provided. Termination will take effect only when the
receipt of the termination request has been received and confirmed
by Prospect Response Billing Department, billing@Prospect Response.com.
Commissions:
Commissions will be paid around the 15th day of each month for the
previous month's commissions to all Resellers who have accumulated
total earnings of $50.00 or more. Any commissions less than $50 in
any given month will be carried forward until they accumulate to $50
or more. Commissions less than $50 will be paid upon request.
Prospect Response
reserves the right to hold pending commission payment when commission
fraud is suspected. In such cases, a thorough investigation will be
done and the member notified accordingly. Prospect Response reserves the
right not to pay such commissions if this such fraud is verified.
An example would be opening multiple accounts for the purposes of
reading money mails to get paid, as this provides no quality to other
members.
Reseller/Affiliate
Agreement
I understand that all dollar amounts posted on the Prospect Response websites
are potential and not actual and that Prospect Response makes no claims
that its Resellers will achieve such levels of commissions. I also
agree that I am an independent contractor and therefore fully responsible
for determining my own business activities, and will bear full responsibility
for the consequences of these actions. Further, I understand that
I am not an employee or legal representative of Prospect Response, and
that I will not attempt to present myself in such a way as to mislead
others into believing that I am an employee or legal representative
of Prospect Response. I understand and agree that I am responsible for
the payment of all federal and state self-employment taxes and any
other taxes that may be required under federal, state, or any regulatory
or taxing authority.
I
also understand and agree that Prospect Response reserves the right to
alter service prices and compensation plan without prior notice. Prospect Response
reserves the right not to pay Reseller commissions to any Reseller
who defaults to any of the policies stated on this agreement.
Disclaimer
of Warranties, Limitation of Liabilities, Indemnification
THE Prospect Response SERVICE IS DISTRIBUTED ON "AS IS" BASIS WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
Prospect Response
WILL NOT BE HELD RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT
YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE Prospect Response SERVICE.
IN NO EVENT SHALL Prospect Response BE LIABLE FOR ANY LOST PROFITS OR
ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR
IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT HOWEVER
ARISING, INCLUDING NEGLIGENCE. BY USING THIS SERVICE, YOU EXPRESSLY
AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. YOU ALSO AGREE
TO HOLD US AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS,
AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING
ATTORNEY FEES MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR
BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE,
OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.
Prospect Response
RESERVES THE RIGHT TO ACQUIRE COURT FEES, ATTORNEY FEES AND ANY OTHER
FEES ALLOWED BY LAW FROM ANY INDIVIDUAL OR ENTITY WHO BRINGS FORTH
A LAWSUIT AGAINST Prospect Response RESULTING FROM ANY AD SUBMISSION TO
THE Prospect Response SERVICE. OUR LIABILITY TO YOU OR ANY THIRD PARTIES
IN ANY CIRCUMSTANCE IS LIMITED TO $100.
